Terms and Conditions for Gardeners Wanstead
Introduction.
These Terms and Conditions set out the basis on which gardening services are provided by Gardeners Wanstead and apply to all bookings, quotations, and work carried out by our team. By making a booking, the client agrees to be bound by these terms. Please read them carefully before confirming any service. These terms are designed to create a clear understanding of what is included in a gardening service, how appointments are arranged, how payments are handled, and what happens if a booking needs to be changed or cancelled. They also explain responsibilities relating to access, safety, waste removal, and legal compliance. For the avoidance of doubt, these terms apply whether the work is a one-off visit, recurring maintenance, or a larger garden project.
Service scope. We provide domestic and commercial gardening services as agreed at the time of booking. The exact scope of work will depend on the customer’s instructions, the condition of the outdoor area, and any limitations discussed before the visit. Common services may include lawn care, hedge trimming, pruning, planting, clearance, and general maintenance. Any tasks not included in the agreed scope may require a revised quotation or a separate booking. The client remains responsible for ensuring that the requested service is suitable for the property and for highlighting any known issues that may affect the work. Where the phrase gardeners in Wanstead is used in these terms, it refers to the service provider and not to a guarantee that all gardening tasks are available at all times.
Quote validity.
Any quotation or estimate is based on the information provided by the client and, where relevant, the visible condition of the garden at the time of inspection. Estimates may change if the actual site conditions differ from those described, if additional work is requested, or if hidden issues are discovered once work has started. A quote is usually valid for a limited period and may be withdrawn or amended if the booking is delayed. We reserve the right to refuse work that is unsafe, unlawful, or outside our competence. Any promotional wording or general service description is for guidance only and does not form a promise that every item will be included in every booking.
Booking Process
Bookings are confirmed only when the client has provided accurate details of the service required and we have accepted the request. The booking process may involve discussing the size of the garden, the condition of the site, access arrangements, the preferred date, and any special instructions. Once a date and time have been agreed, the client will receive confirmation of the appointment and the agreed scope. It is the client’s duty to check the confirmation carefully and notify us of any errors as soon as possible. If access is restricted, if parking limitations apply, or if permits are needed, the client must make these arrangements in advance unless otherwise agreed.
Appointments are allocated in good faith and are subject to weather, staff availability, and operational requirements. While we aim to arrive within the scheduled time, start times may vary due to traffic, previous jobs, or unforeseen delays. If a visit needs to be rescheduled, we will make reasonable efforts to arrange an alternative time. The customer agrees to ensure that pets are secured, vulnerable items are moved out of the work area where necessary, and the garden can be accessed safely. Any delay caused by lack of access, absence of the client where required, or inaccurate information may be treated as a late cancellation or no-show.
Customers booking with Gardeners Wanstead are responsible for confirming that the person placing the booking has authority to do so. If a booking is made on behalf of a landlord, tenant, managing agent, or business, that person confirms they have permission to authorise the service.
We may rely on the instructions given by the named booking contact until advised otherwise in writing. We are not responsible for disputes between third parties about who authorised the work, provided that the service was supplied in good faith according to the booking details supplied.
Payments
Payment terms will be stated at the time of booking or on the invoice. Unless agreed otherwise in writing, payment is due in full on completion of the work or within the period shown on the invoice. We may request a deposit for larger projects, repeated visits, or bookings requiring significant preparation. Accepted payment methods may vary and will be confirmed in advance. Late payment may result in suspension of further work, cancellation of outstanding appointments, or recovery action where appropriate. Any bank charges, card fees, or collection costs incurred due to failed payment may be added to the amount owed where permitted by law.
If the quotation is based on an hourly rate, the final price will reflect the time worked plus any agreed materials or disposal charges. If a fixed price has been agreed, that price will apply only to the work described in the booking confirmation. Additional requests made during the visit may be charged separately. We will make reasonable efforts to keep the client informed if the scope of work changes and may seek approval before continuing where a material increase in cost is expected. Discounts, offers, or package prices are offered at our discretion and may be withdrawn at any time without affecting already accepted bookings.
All amounts are stated in pounds sterling unless otherwise agreed. Gardeners Wanstead may issue invoices electronically. The client agrees to check invoices promptly and raise any query within a reasonable period. Failure to raise a timely dispute does not remove the obligation to pay for services that were properly delivered. If the client disputes part of an invoice, the undisputed amount must still be paid by the due date. We may withhold further services until overdue balances have been settled in full.
Cancellations, Rescheduling, and No-Shows
Clients may cancel or reschedule a booking by giving reasonable notice. The amount of notice required may depend on the size and type of service booked, but as a general rule, earlier notice is more likely to avoid cancellation charges. If cancellation occurs after work has already started, the client may be charged for the time spent, materials used, and any reasonable costs already incurred. Where a deposit has been taken, it may be retained to cover administrative or preparatory costs unless otherwise stated. If a cancellation is made because of severe weather or unsafe site conditions, we may offer a new appointment rather than a refund, depending on the circumstances.
If the client fails to provide access, is not available where attendance or approval is required, or does not ensure the site is ready for the agreed service, the appointment may be treated as a failed visit. In such cases, a minimum charge or the full booked amount may apply. We understand that genuine emergencies can arise and will consider reasonable requests compassionately, but this does not remove the client’s responsibility to notify us as early as possible. Repeated last-minute changes may lead to the requirement for prepayment or the refusal of future bookings.
We may cancel or reschedule a service if the weather, site conditions, equipment issues, staff illness, or another event outside our control makes it impractical or unsafe to proceed. When this occurs, we will aim to offer a new appointment at a convenient time. We will not be liable for indirect losses caused by such changes, provided that the cancellation or delay was reasonable and made in good faith.
Customers using Wanstead gardeners services acknowledge that outdoor work is inherently affected by seasonal and environmental conditions, and flexibility may sometimes be required.
Liability and Limitations
We will carry out services with reasonable care and skill. However, gardening work can involve natural surfaces, living plants, sharp tools, and variable site conditions. To the fullest extent permitted by law, we do not accept liability for pre-existing defects, structural issues, hidden underground objects, unstable ground, dead vegetation, or damage caused by items not reasonably identifiable before the work began. The client should inform us of any known hazards, including fragile fittings, irrigation systems, buried cables, or recently treated surfaces. We may decline to work in areas that appear unsafe or unsuitable.
Where we are responsible for loss or damage, our liability will be limited to the reasonable cost of repair or replacement, or the amount paid for the relevant service, whichever is lower, except where such limitation is not permitted by law. Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded. Clients are encouraged to keep valuables, ornaments, and fragile items away from the working area, and to ensure that outdoor furniture or decorations are protected if they are at risk of being disturbed.
We are not responsible for deterioration that occurs due to natural weathering, drought, flooding, pests, disease, or ordinary plant growth after a service has been completed. For plant-related work, results may vary according to the health of the plant, soil quality, season, and future care. Any advice provided verbally or in writing is offered in good faith and should be considered general guidance only unless a separate professional agreement is in place. The client accepts that living materials are subject to natural variation and cannot be guaranteed in the same way as manufactured goods.
Waste Regulations and Site Clearance
Waste generated during gardening services, including grass cuttings, hedge trimmings, leaves, branches, and general green waste, will be handled in accordance with applicable waste rules and environmental requirements. Unless otherwise agreed, waste removal is not included in the base price and may be charged separately. Any waste we transport will be disposed of through lawful channels. The client agrees not to ask us to remove prohibited items or materials that require specialist disposal unless this has been agreed in advance and can be done lawfully.
Where waste is left on site for collection or composting, the client is responsible for confirming the chosen arrangement. We do not accept responsibility for waste left in public areas, unless such placement was specifically agreed for collection and is compliant with local rules. The client should also ensure that any bins, skips, or disposal areas designated for the job are suitable and accessible. If contaminated materials, sharp objects, or non-garden waste are discovered during the service, we may pause the work and discuss the safest lawful method of dealing with them before continuing.
All parties must comply with environmental and waste-handling duties. This includes ensuring that garden waste is not mixed with materials that require separate processing and that no illegal dumping takes place. The service provider may refuse to remove any item where there is a risk of breaching waste regulations. If a client requests the removal of soil, rubble, timber, or other mixed waste, we may need to apply additional charges or decline the request altogether. The phrase garden care in Wanstead is used in a broad commercial sense and does not override legal waste responsibilities.
Client Responsibilities
Clients must provide accurate instructions, safe access, and a reasonably clear working environment. Any hazards should be disclosed before the job starts. This includes hidden water features, unstable paving, electrified garden equipment, or areas recently treated with chemicals. The client should ensure children and animals are kept away from the work area while the service is in progress. If keys, codes, or entry instructions are provided, the client is responsible for making sure they are correct and that access arrangements are lawful.
The client agrees to review the completed service promptly and notify us of any concerns within a reasonable time. If a matter is not raised quickly, we may assume that the work was accepted as completed, subject to any rights that cannot be waived by law. Where ongoing maintenance is arranged, the client should understand that plant health, weed regrowth, and seasonal change may require repeated visits. No service can eliminate all future natural growth, and any maintenance plan should be viewed as a continuing arrangement rather than a permanent solution.
We may suspend or end a booking if the client behaves abusively, creates unsafe conditions, refuses reasonable payment terms, or insists on work that is unlawful or outside the agreed scope. In such cases, charges may still apply for completed work or for expenses already incurred. These terms are intended to be fair and balanced, and no waiver of any provision will be effective unless agreed in writing. A failure to enforce a term on one occasion does not mean it is waived for future bookings.
Governing Law
These Terms and Conditions, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales will have non-exclusive jurisdiction over any legal proceedings, subject to any mandatory consumer rights that apply. If any part of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The headings in this document are for convenience only and do not affect interpretation.
By making a booking, the client confirms that they have read, understood, and accepted these terms. The agreement between the client and Gardeners Wanstead consists of the booking confirmation, any written quotation, and these Terms and Conditions together. If there is any inconsistency, the written quotation or booking confirmation may take priority for that specific service, provided it does not conflict with mandatory law. These terms may be updated from time to time, and the version in force at the time of booking will apply unless a later written agreement states otherwise.
For clarity, no provision in these Terms and Conditions is intended to limit the consumer’s statutory rights where such rights apply. We aim to provide a professional, transparent service and to resolve issues reasonably where possible.
Final acceptance of work, payment, or continued use of services after an update to these terms will be taken as acknowledgement of the latest applicable version. Wanstead gardening services remain subject to these conditions whether the work is carried out once, occasionally, or on a recurring basis.
